Another Coward Punch Death, Another Arsehat Of A Magistrate

Howard started Scene Magazine in 1993. Paul Keating was Prime Minister. Whitney, Janet and Mariah all had Aussie #1s and Mark Zuckerberg was 9. Over 30 years he's overseen the growth of scenestr magazine to become Australia's largest – and only national – street press while forging a digital-first imperative for the title in the mid-naughties. He's judged more battle of the bands than he cares to remember and proud of the myriad media partnerships the company has earned across the music, arts and comedy sectors. He likes Star Trek and a good Oxford Comma – way too much fun at parties.

The community continues to seethe over the culture of one-punch attacks and the wanting sentences handed out to perpetrators, as demonstrated by arsehat magistrate Rod Madsen in Maroochydore.

The one-punch issue is again tragically in the spotlight today following the death of 18-year-old Cole Miller after he was punched in the head in Brisbane's Chinatown Mall this past weekend where he was set upon by up to four men in the early hours of Sunday morning.

In 2014, the Newman Queensland government introduced new laws with a mandatory life sentence for people convicted of 'unlawful striking causing death'. Offenders face a maximum of life imprisonment and will be required to serve at least 80 per cent of their sentence behind bars.

Notwithstanding the public outcry and politicians introducing new laws, last October Maroochydore magistrate Rod Madsen proved himself an out-of-touch arsehat (who incidentally clearly dresses himself with his eyes closed) when he incredulously declined to view evidentiary footage of an assault claiming videos can be 'too emotive' and instead he 'liked to rely on the evidence... facts.' I'd like to ask the Honourable Arsehat what sort of evidence he feels feels video footage constitutes.

The Daily Mail reported Madsen allowed Tyson Joel Wylie, 26, to walk free from court and ordered him to pay $5,000 to the victim and was served a 24-month prison sentence, suspended for three years.

Incredibly, the attack came less than a week after Wylie knocked another man unconscious on Cavill Ave in Surfers Paradise. On that occasion, notoriously 'soft' magistrate Bernadette Callaghan (another arsehat) fined Wylie just $1,500 and told him, "don't ever do that again".

In NSW, boxing champion Danny Green has fronted the NSW Government’s new laws, which aim to stop drug- and alcohol-related violence.

The new laws include a 20-year maximum sentence for anyone who unlawfully assaults another who dies as a direct or indirect result of the assault. If the offender was intoxicated by alcohol or drugs, a minimum of eight years and a maximum 25 year sentence applies.
